These Terms apply to: - visitors to our website, - people contacting us or requesting demos, - customers using the Astos platform and related services, - any user accessing Astos under an authorized account. If you use Astos on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Astos provides AI-powered voice, automation, customer communication, workflow, analytics, and related software services. We may update, improve, modify, or discontinue parts of the services from time to time. Certain services may also be governed by separate commercial agreements, order forms, data processing agreements, or service-specific terms. Where those documents conflict with these Terms, the more specific agreement will prevail.

You agree to use Astos only in compliance with applicable law and these Terms. You may not use Astos to: - violate any law or regulation, - infringe the rights of others, - process data without appropriate legal basis or permissions, - engage in unlawful marketing, fraud, harassment, or abuse, - interfere with or disrupt the services, - attempt unauthorized access, - reverse engineer or misuse the platform except where permitted by law.

You are responsible for ensuring that your use of Astos complies with all applicable laws and regulations, including those relating to: - privacy and data protection, - telecommunications, - direct marketing, - call recording, - consumer protection, - sector-specific requirements applicable to your business. You are also responsible for providing any required notices and obtaining any required consents relating to your use of AI voice agents, customer communications, recordings, transcripts, and customer data.

If you receive account access to Astos, you are responsible for: - maintaining the confidentiality of login credentials, - restricting unauthorized access, - ensuring account information is accurate, - all activities carried out through your account. You must notify us promptly if you suspect unauthorized use of your account.

As between Astos and the customer, the customer retains ownership of customer data submitted to or processed through the services. You grant Astos the rights necessary to host, process, transmit, analyze, and otherwise use customer data solely for the purpose of providing, maintaining, securing, supporting, and improving the services, and as otherwise permitted by applicable agreement and law. Where permitted by law and contract, Astos may use aggregated and de-identified data for analytics, benchmarking, security, and product improvement.

Astos and its licensors retain all rights, title, and interest in and to the platform, software, models, interfaces, documentation, branding, and related intellectual property. These Terms do not grant you ownership of the services or of Astos intellectual property. You may not copy, modify, distribute, sublicense, sell, or create derivative works from the services except as expressly permitted.

If you purchase paid services, you agree to pay all fees stated in the applicable order form, invoice, or commercial agreement. Unless otherwise agreed in writing: - fees are exclusive of applicable taxes, - payment obligations are non-cancelable, - fees paid are non-refundable except where required by law. We may suspend access to paid services for overdue invoices, subject to applicable agreement terms.

Each party may receive confidential information from the other. The receiving party agrees to: - use confidential information only as necessary for the relationship, - protect it with reasonable care, - not disclose it except to people who need to know and are bound by confidentiality obligations, or where disclosure is required by law. These obligations do not apply to information that is publicly available through no fault of the receiving party, already lawfully known, independently developed, or lawfully obtained from a third party.

Astos may integrate with or rely on third-party services. Your use of those services may also be subject to third-party terms and policies. Astos is not responsible for third-party products or services that it does not control.

We aim to keep Astos available, secure, and reliable, but we do not guarantee uninterrupted or error-free service. We may modify features, functionality, or technical requirements from time to time.

To the maximum extent permitted by law, Astos is provided on an "as is" and "as available" basis. Except as expressly agreed in writing, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not guarantee specific revenue outcomes, legal outcomes, or business results from use of the services.

To the maximum extent permitted by law, Astos and its affiliates, directors, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunity. To the maximum extent permitted by law, Astos's total aggregate liability arising out of or relating to the services or these Terms will not exceed the total fees paid by you to Astos during the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability where such limitation is not permitted under applicable law.

You agree to indemnify and hold harmless Astos and its affiliates, directors, officers, employees, and agents from claims, damages, liabilities, costs, and expenses arising out of: - your use of the services, - your breach of these Terms, - your violation of applicable law, - your infringement of third-party rights, - your failure to obtain required rights, notices, or consents.

We may suspend or terminate access to the services if: - you breach these Terms, - your use creates legal, security, or operational risk, - required by law, - payment obligations remain overdue, - your agreement with us ends. You may stop using the services at any time, subject to any active commercial agreement. Any provisions that by their nature should survive termination will survive, including those relating to payment, confidentiality, intellectual property, disclaimers, liability, and governing law.

These Terms are governed by the laws of Sweden, without regard to conflict of laws principles. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Stockholm, Sweden, unless otherwise required by applicable law.

We may update these Terms from time to time. Updated versions will be posted on our website with a revised "Last updated" date. By continuing to use Astos after updated Terms become effective, you agree to the revised Terms.
